Cosmic Byte – Terms & Conditions

All information, products, and services displayed on www.thecosmicbyte.com (the “Website”) constitute an invitation to offer. Any order placed by a user (“User” / “Customer”) constitutes an offer to purchase, which shall be subject to these Terms & Conditions. Cosmic Byte reserves the right to accept or reject any offer, in whole or in part, at its sole discretion, without assigning any reason.

By accessing, browsing, or using the Website, the User agrees to be bound by these Terms & Conditions. Cosmic Byte reserves the right to add, modify, suspend, or remove any part of these Terms & Conditions at any time without prior notice. Users are advised to review these Terms & Conditions periodically.

  1. Product Representation

Every effort has been made to accurately display product images, specifications, and colors on the Website. However, actual product appearance may vary depending on device display settings. Cosmic Byte does not guarantee that the display of any color or image on the User’s device will be accurate.

  1. Eligibility

The User represents and warrants that they are at least 18 (eighteen) years of age, or are accessing the Website under the supervision and consent of a parent or legal guardian.

  1. Limitation of Liability

Cosmic Byte shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, loss of revenue, or business interruption arising out of or in connection with the use or inability to use the Website or services, including but not limited to:

  • Delays, non-delivery, or missed deliveries
  • Service interruptions or system failures
  • Errors, omissions, defects, or performance failures
  • Computer viruses or unauthorized access
  • Theft, destruction, or alteration of records

This limitation applies whether liability arises under contract, tort, negligence, or any other legal theory.

  1. Shipping Responsibility, Delivery Attempt & Force Majeure

4.1 Shipping Responsibility

Cosmic Byte shall take reasonable responsibility for orders shipped to serviceable locations where delivery is carried out using reputed Indian courier and logistics partners, including but not limited to Bluedart, Delhivery, Ecom Express, XpressBees, Shadowfax, Amazon Shipping, Blitz, and Pickrr (or any other equivalent logistics service provider), until a delivery attempt is made at the address provided by the User.

4.2 Definition of “Delivery Attempt”

A “Delivery Attempt” shall mean:

  • At least two physical attempt by the assigned courier partner to deliver the shipment at the delivery address provided by the User; and
  • Such attempt may include contacting the User via phone call, SMS, or other communication modes; and
  • The shipment being marked as “Attempted”, “Undelivered – Customer Not Available”, “Incorrect Address”, “Refused”, or equivalent status in the courier tracking system.

Once a delivery attempt is recorded by the courier partner, Cosmic Byte’s delivery obligation for that shipment shall be deemed fulfilled.

4.3 Courier Delay & Force Majeure

Cosmic Byte shall not be liable for delays or failure in delivery caused by events beyond its reasonable control, including but not limited to:

  • Natural disasters, floods, earthquakes, storms, or fires
  • Acts of God, war, riots, civil unrest, strikes, or lockdowns
  • Government orders, regulatory restrictions, or transport bans
  • Courier network disruptions, manpower shortages, or operational failures
  • Pandemic-related delays or force majeure events

In such cases, delivery timelines shall be extended accordingly, and no refunds, cancellations, or compensation shall be payable for delays arising due to such events.

  1. Pricing & Availability

All product prices, descriptions, and availability are subject to change without prior notice, at the sole discretion of Cosmic Byte. Errors in pricing or product information may result in order cancellation.

  1. Order Cancellation by User

Requests for cancellation of orders may be entertained only before the order has been shipped, unless otherwise required under applicable law or expressly stated on the Website.

Once an order has been shipped, cancellation shall not be permitted. In such cases, the User may refuse to accept delivery at the time of delivery. Upon refusal, the product shall be returned to Cosmic Byte’s warehouse through the logistics partner.

For prepaid orders, a refund shall be initiated only after the refused shipment is received back at Cosmic Byte’s warehouse and verified for integrity. Refunds shall be processed to the original mode of payment within the standard processing timelines.

Cosmic Byte reserves the right to deduct applicable shipping, handling, or return-to-origin (RTO) charges, where permitted under applicable law, before initiating the refund.

  1. Order Cancellation by Cosmic Byte

Cosmic Byte reserves the right to refuse or cancel any order for reasons including but not limited to pricing errors, stock unavailability, suspected fraud, or operational constraints, whether or not the order has been confirmed or payment received.
In such cases, any amount paid shall be refunded to the original payment method.

  1. Incorrect Address / Failed Delivery

If delivery fails or is delayed due to incorrect, incomplete, or misleading information provided by the User, or due to the unavailability of the recipient, any additional costs incurred for re-delivery shall be borne by the User.

  1. User Information & Account Integrity

The User agrees to provide accurate, complete, and up-to-date information. Cosmic Byte reserves the right to verify User details and may suspend or terminate access if any information is found to be false or misleading, without prior notice.

  1. Payment & Fraud Prevention

Cosmic Byte shall not be responsible for any credit/debit card or payment fraud. The User agrees to use only authorized payment instruments, and liability for fraudulent transactions shall rest solely with the User.

  1. Complaints & Claims Window

Cosmic Byte shall not entertain any complaints, disputes, or claims after 7 (seven) days from the date of successful delivery of the order.

  1. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
The courts at Pune, Maharashtra, shall have exclusive jurisdiction over all disputes arising out of or relating to these Terms & Conditions.

 

Cosmic Byte Rewards Program Policy

This Cosmic Byte Rewards Program Policy (“Policy”) governs the earning, use, redemption, and forfeiture of reward points (“Bytes”) issued by Cosmic Byte through its official website.

By participating in the Cosmic Byte Rewards Program, customers agree to be bound by this Policy and the general Terms & Conditions of the Cosmic Byte website.

  1. Overview of the Cosmic Byte Rewards Program

The Cosmic Byte Rewards Program is a customer engagement and promotional initiative under which eligible customers may earn reward points known as “Bytes” for performing certain actions on the Cosmic Byte website, including but not limited to:

  • Product purchases
  • Promotional, marketing, or engagement activities as determined by Cosmic Byte from time to time

Bytes are issued solely at the discretion of Cosmic Byte.

  1. Nature of Bytes
  • Bytes are not currency, not digital assets, and not property of the customer.
  • Bytes have no monetary value and cannot be exchanged for cash, bank transfer, wallet balance, or any other monetary instrument.
  • Bytes do not constitute stored value, prepaid instruments, or electronic money under applicable laws.
  • All ownership, title, and interest in Bytes remain exclusively with Cosmic Byte at all times.
  1. Earning of Bytes
  • Bytes may be earned only through actions expressly defined and approved by Cosmic Byte.
  • The number of Bytes earned per action may vary and may be modified, reduced, or withdrawn at any time without prior notice.
  • Cosmic Byte reserves the right to withhold, reverse, adjust, or cancel Bytes credited due to system error, misuse, suspected fraud, or violation of applicable terms.
  1. Redemption of Bytes
  • Bytes may be redeemed only for discount coupons usable on the Cosmic Byte website.
  • Minimum Order Value (MOV): ₹500 is mandatory for redemption of any coupon generated using Bytes.
  • Coupon values, redemption ratios, and eligible products are determined solely by Cosmic Byte and may change at any time.
  • Bytes are non-transferable and cannot be sold, gifted, assigned, or combined across accounts.
  1. No Ownership or Customer Rights
  • Customers acknowledge that they do not own the Bytes credited or displayed in their account.
  • Bytes do not create any vested, contractual, proprietary, or enforceable rights.
  • Accumulation, display, or use of Bytes does not impose any obligation or liability on Cosmic Byte.
  1. Retraction, Expiry, and Cancellation

Cosmic Byte reserves the absolute and unconditional right, at its sole discretion, to:

  • Retract, expire, reduce, or cancel any Bytes
  • Modify redemption terms or coupon availability
  • Suspend or permanently discontinue the Cosmic Byte Rewards Program

Such actions may be taken at any time, with or without notice, and without any monetary compensation or liability.

  1. Abuse, Fraud, and Misuse

Bytes may be immediately forfeited if Cosmic Byte determines that a customer has:

  • Engaged in fraudulent or suspicious activity
  • Misused or attempted to manipulate the rewards system
  • Violated the website’s Terms & Conditions or applicable laws

Cosmic Byte’s decision in such matters shall be final and binding.

  1. Program Modification or Termination

Cosmic Byte may amend, revise, suspend, or terminate this Policy or the Cosmic Byte Rewards Program at any time. Continued participation following any changes constitutes acceptance of the revised Policy.

  1. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India, and courts having jurisdiction at Cosmic Byte’s registered office shall have exclusive jurisdiction.

Bytes are promotional loyalty points issued at the sole discretion of Cosmic Byte. They are revocable, non-transferable, non-monetary, and do not confer any ownership, monetary value, or legal rights upon customers.
